These Terms and Conditions (the “Terms”) govern your use of BetterAnnuityComp.com (the “Site”). The Site is operated by BetterLifeQuotes.com LLC, 8325 SW 197th Ter, Miami, FL 33189 (the “Company,” “we,” “us” or “our”). BetterAnnuityComp.com is powered by BetterLifeQuotes.com. By using the Site or submitting an application, you agree to these Terms. If you do not agree, do not use the Site.

1. Who the Site is for

The Site provides information about annuity carrier contracting, starting compensation, case management and related support for licensed insurance professionals, agencies, financial advisors and healthcare agencies. It is not a consumer insurance marketplace, does not offer annuities or insurance to the public, and does not provide tax, legal or investment advice. You must be at least 18 years old to use the Site.

2. Compensation information and our higher-commission commitment

Starting comp, product and carrier information on the Site reflects carrier commission schedules as of the date shown. Compensation can vary by state, product version, premium amount, owner or annuitant age and the commission option elected, and carriers can change schedules at any time.

Our commitment: no matter your current commission level, if you meet the minimum requirements in section 4, we will contract you at a higher commission level than your current documented level with each carrier we compare with you. “Documented” means shown on a current commission schedule, contract or statement you provide. This applies to carriers available through us and is subject to each carrier’s appointment approval and release rules. You see your new levels before you move anything, and your executed contracting documents set your final schedule.

Other than this commitment, nothing on the Site guarantees production, income or carrier appointment. Your compensation is governed solely by your executed contracting documents and the applicable carrier agreements. Chargebacks apply under each carrier’s rules. Product names are trademarks of their respective owners.

3. Applications and contracting

Submitting an application does not create any agreement, appointment or relationship. We may accept or decline any application in our sole discretion. Carrier appointments are subject to each carrier’s own approval process. Some marketing and practice-building programs described on the Site are delivered by independent partners and may carry their own fees and terms.

4. Minimum requirements and truthful representations

Solo annuity producers have no minimum requirements: there is no experience requirement and no minimum production volume, and new producers with no experience start at our starting comp. Carriers still appoint only producers who hold an active insurance license with the life/annuity line of authority and who complete the annuity training their state and each carrier require. Financial advisors and established agencies must meet the requirements published on their application pages, including (for financial advisors) at least 12 months of continuous annuity experience (there is no minimum production volume), an active resident license with the life/annuity line of authority, their own errors and omissions (E&O) coverage, current anti-money-laundering (AML) certification, completed state-required annuity best-interest/suitability training, a clean background, no outstanding debt or chargeback balance with any carrier or upline, and appointment with at least one annuity carrier. Healthcare agencies apply under their own application and are exempt from these requirements.

Every applicant represents that all information submitted is true, complete and not misleading, and agrees to provide supporting documents on request, such as commission statements, proof of E&O coverage and AML and annuity training certificates, where applicable. You authorize us to verify your licenses, appointments, carrier debt and background. If any representation is false or misleading, we may decline the application or immediately terminate any resulting agreement or relationship.

5. Direct applications only

Applications must be submitted directly by the applying producer or advisor, or by an owner or authorized principal of the applying agency, using the forms on the Site. We do not accept producers, advisors or agencies that were contacted, solicited, recruited or referred to us by any recruiter, recruiting service, marketing organization, lead or referral service, or other third party (a “Third-Party Recruiter”), and we do not pay any compensation, override, finder’s fee or referral fee to any Third-Party Recruiter. An agency is not a Third-Party Recruiter with respect to its own existing agents that it brings with it.

By applying, you represent that you were not contacted, recruited or referred to us by a Third-Party Recruiter and that you are applying on your own behalf or on behalf of an agency you own or are authorized to represent. We are not responsible for any statement, promise or request made by anyone claiming to recruit for or represent BetterAnnuityComp.com or BetterLifeQuotes.com. Please report any such contact to contact@betterlifequotes.com.

6. Acceptable use

You agree not to misuse the Site, including by submitting false information, attempting to gain unauthorized access, interfering with the Site’s operation, scraping it in a way that burdens it, or using it for any unlawful purpose.

7. Intellectual property

The Site’s content, design and compilation of information, including the starting-comp tables, are owned by the Company or its licensors and are protected by law. You may view and share pages for your own business use. You may not republish or resell substantial portions of the Site without our written permission. Carrier and product names belong to their respective owners.

8. Third-party links

The Site links to third-party websites, such as industry and government sources. We do not control and are not responsible for third-party content or practices.

9. Disclaimers

The Site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. Industry statistics, tax and regulatory information on the Site are summaries for licensed professionals and may change; always confirm current rules and carrier requirements before advising a client.

10. Limitation of liability

To the fullest extent permitted by law, the Company and its officers, members, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or business, arising out of or related to your use of the Site.

11. Indemnification

You agree to indemnify and hold harmless the Company and its officers, members, employees and partners from any claims, losses and expenses, including reasonable attorneys’ fees, arising from your misuse of the Site, your violation of these Terms or any inaccurate information you submit.

12. Governing law and dispute resolution

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Site will be resolved by binding individual arbitration, except that either party may bring an individual claim in small claims court or seek injunctive relief for misuse of intellectual property. You waive any right to participate in a class action or class-wide arbitration and any right to a jury trial, to the extent permitted by law.

13. Changes and termination

We may update these Terms at any time by posting a revised version on this page with a new effective date. Your continued use of the Site means you accept the updated Terms. We may suspend or end access to the Site at any time.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
